We warrant to you that that on delivery, the goods supplied to you will:
    (a) conform in all material respects with their description on this website at the time of your order;
    (b) be free from material defects in design, material and workmanship;
    (c) be of satisfactory quality (within the meaning of the Sale of Goods Act 1979); and (d) be fit for any purpose held out by us.
    These warranties are given in addition to your cancellation rights.
    In order to enjoy the above warranties, you must inspect the goods within a reasonable period from delivery.  In most cases we consider a reasonable period to be 5 working days from delivery.
    For certain products (for further details please contact us), we are pleased to offer an extension of the above warranty for 12 months from the date of delivery on condition that you complete a warranty registration form (available here or contact us on phone number: 01752 228563 or e-mail address:info@funkyspas.co.uk) and return this to us within 28 days of the date of delivery confirming receipt of the goods in good condition and that they have been properly installed by an engineer approved by us. If you do not complete the warranty registration form unfortunately we cannot accept any liability for any defects or faults arising after delivery.
    In order to bring a claim under any of the above warranties, please notify us within a reasonable period from the date of delivery or, if the extended warranty applies, during the warranty period of discovery that some or all of the goods do not comply with the above warranties.
    We reserve the right to require you to return the relevant goods to us for examination before we can accept any liability under the warranties.  It is important you get an ‘RA’ number from us prior to sending anything to us.
    We cannot accept liability under the above warranties if:
    (a) you or anyone else makes any further use of the goods after giving notice of a defect to us; or
    (b) the defect arises because you have failed to follow our oral or written instructions as to the storage, commissioning, installation, use and maintenance of the goods or good trade practice regarding the same; or
    (c) you alter or repair the goods without our written consent; or
    (d) the defect arises as a result of fair wear and tear, wilful damage, negligence, or abnormal storage or working conditions; or
    (e) the goods only differ from their description as a result of changes made to ensure they comply with applicable statutory or regulatory requirements.
    If some or all of the goods do not comply with the warranty, we will, at our option, repair or replace the defective goods, or refund the price of the defective goods (and the costs of returning the goods to us) in full.  Please note that depending on the work load at the time repairs can take anything between 1 and 3 weeks and sometimes longer depending on the availability of replacement parts.
    We will not otherwise have any liability to you in respect of the failure of any of the goods to comply with the above warranties and the terms implied by sections 13 to 15 of the Sale of Goods Act 1979 are, to the fullest extent permitted by law, excluded from the contract.
    These arrangements will apply equally to any repaired or replacement goods supplied by us
    (f) the minimum spend on all orders are £7.50
